These Terms of Service ("Terms") govern your access to and use of the CheckEt: Your Digital Label Reading and Food Literacy Assistant ("the App").
By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Description of Service and Educational Purpose
CheckEt is a digital accessibility and food literacy tool designed to assist users in digitizing product labels via Optical Character Recognition (OCR) and matching ingredient data with user-defined criteria. The App does not score, rank, or provide a "health grade" for products on its own authority; it functions as a digital assistant to highlight information based strictly on User-Defined Preferences.
2. MEDICAL DISCLAIMER & SAFETY LIMITATIONS
PLEASE READ CAREFULLY: CheckEt IS NOT A MEDICAL DEVICE OR DIAGNOSTIC TOOL.
- Informational Purposes Only: All data matches and ingredient definitions are provided for educational purposes only. They do not constitute medical advice, diagnosis, or treatment.
- No Guarantee of Accuracy: Due to potential manufacturing changes, OCR misreadings, or AI hallucinations, results are NOT 100% GUARANTEED.
- User Obligation: Individuals with severe allergies or medical conditions MUST NOT RELY SOLELY on the App. You must always verify the physical packaging. CheckEt expressly disclaims all liability for health outcomes resulting from reliance on App data.
3. Artificial Intelligence (AI) Transparency (2026 Global Compliance)
In accordance with the EU AI Act and modern transparency standards, users acknowledge that:
- AI-Generated Content: All digitized summaries and summaries are generated or assisted by artificial intelligence.
- 6-Hour Response Protocol: We maintain a rapid-response system to review and address reported data inaccuracies within 6 hours of notification.
- Objection Rights: Users have the right to object to automated profiling or AI-driven matching results and request manual clarification.
4. Brand Protection and Fair Use
To comply with international trade laws regarding fair competition:
- Users agree not to use the App's objective matching data to engage in trade libel or product disparagement against any brand or manufacturer.
- The App is intended to provide transparency for personal use. Subjective interpretation or public sharing of matching results with the intent to harm a brand's commercial reputation is strictly prohibited.
5. Account Management and Special Category Data
- Personal Preferences: Dietary choices and sensitivities defined in your profile may be considered "Special Category Data" (Health Data) under the GDPR and other data protection laws. This data is processed solely to provide your personalized matching service.
- Security: Users are responsible for maintaining the security of their account credentials.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CheckEt TEAM SHALL NOT BE LIABLE FOR:
- Inaccuracies in label information provided by manufacturers.
- Technical errors resulting from the use of third-party AI models (e.g., Google Gemini).
- Incidental or consequential damages related to the consumption of products based on App matches.
